Terms and Conditions for Waste Collection Elephant and Castle
These Terms and Conditions set out the basis on which we provide waste collection services in and around Elephant and Castle within the United Kingdom. By placing a booking, confirming a quotation, or allowing our operatives to collect waste from your premises, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our services.
1. Definitions
In these Terms and Conditions, the following definitions apply:
1.1 Client, you or your means the individual or business requesting or receiving our waste collection services.

2. Scope of Services

2.2 The specific nature and scope of the Services, including the type and approximate volume of waste to be collected, will be agreed with you at the time of booking or quotation.
2.3 We reserve the right to decline any job or part of a job at our sole discretion, including where we reasonably believe the waste is hazardous, unsafe, illegal to transport, or beyond our quoted capacity.
3. Booking Process
3.1 You may request a booking by telephone, email, online form, or any other contact method we make available. You must provide accurate and complete information, including your contact details, collection address, description and volume of waste, access requirements, and any time constraints.
3.2 Any quotation given before attending the Premises is an estimate based on the information you provide. If, upon arrival, the actual volume, weight, access conditions or nature of the waste differ from your description, we may revise the price before starting work.
3.3 A booking will be confirmed only when we have acknowledged your request and given a collection date or time window. We may, at our discretion, require a deposit or full prepayment as a condition of confirming the booking.
3.4 You are responsible for ensuring that someone authorised is present at the Premises at the agreed time to grant access, confirm the items to be removed, and approve any variations to the service or price.
3.5 We will use reasonable efforts to attend within the agreed time window, but all arrival times are estimates and may be subject to delays caused by traffic, weather, operational issues or other circumstances beyond our reasonable control.
4. Access and Client Responsibilities
4.1 You must ensure safe, reasonable and lawful access to the Premises for our staff and vehicles, including adequate parking or stopping space where required.
4.2 You must clearly separate and identify the waste to be collected. Our operatives will not be responsible for distinguishing between items to be removed and items to be retained unless specifically agreed.
4.3 You warrant that you either own the waste or have full authority from the owner to authorise its removal. You agree to indemnify us against any claim arising from the removal of items where you lacked appropriate authority.
4.4 You must inform us in advance of any potential hazards at the Premises, including but not limited to fragile structures, dangerous surfaces, restricted access, or hazardous substances.
4.5 We reserve the right to refuse to handle any waste or to work in any area that we consider unsafe or unsuitable, at our absolute discretion.
5. Waste Types and Exclusions
5.1 We operate in accordance with UK waste regulations and our own licences and permits. Certain items may be restricted, require special handling, or incur additional charges.
5.2 Unless expressly agreed in writing, we do not accept or carry hazardous or specialist waste, including but not limited to asbestos, clinical or medical waste, explosives, corrosives, radioactive materials, gas cylinders, chemicals, solvents, oils, fuels, paint tins containing liquid, or electrical items requiring licensed treatment beyond our standard service.
5.3 If prohibited or hazardous waste is discovered among your items, we may refuse to remove it, adjust the price, or terminate the service. You may be liable for any additional costs we incur in dealing with such waste and for any breach of waste regulations arising from your actions or omissions.
5.4 We may, at our discretion, agree to collect certain specialist items where lawful and safe to do so, subject to separate terms, pricing and disposal arrangements.
6. Pricing and Payment
6.1 Our charges are typically based on a combination of volume, weight, labour time, access conditions, and any disposal or recycling fees. We will explain the basis of our pricing structure at the time of quotation.
6.2 All prices are quoted in pounds sterling and may be subject to VAT where applicable. Any such tax will be clearly stated on your invoice where charged.
6.3 Unless otherwise agreed, payment is due on completion of the collection and before our vehicle leaves the Premises. We may accept payment by cash, card, bank transfer or other methods notified to you in advance.
6.4 For account clients or agreed credit terms, payment must be made within the period specified on the invoice. We reserve the right to charge interest and reasonable recovery costs on late payments in accordance with applicable UK law.
6.5 If, after arriving at the Premises, the actual quantity or nature of the waste differs materially from your original description, we will inform you of any price adjustment before proceeding. If you do not accept the revised price, you may cancel the service at that point, subject to any applicable call-out or minimum charge.
7. Cancellations and Changes
7.1 You may cancel or reschedule your booking by giving us notice by telephone or email. The amount of notice you provide will affect any cancellation charges.
7.2 If you cancel more than 24 hours before the scheduled collection time, any prepaid amount may be refunded or applied to a future booking at our discretion, subject to any non-refundable costs already incurred.
7.3 If you cancel within 24 hours of the scheduled collection time, or if we are unable to complete the job because you fail to provide access or the necessary authorisation at the appointed time, we may apply a cancellation fee or minimum call-out charge.
7.4 We reserve the right to cancel or reschedule a booking due to circumstances beyond our control, including but not limited to operational issues, severe weather, vehicle breakdowns, staff shortages or compliance requirements. In such cases, we will endeavour to inform you as soon as reasonably possible and offer an alternative appointment. We will not be liable for any indirect loss or consequential damages resulting from such cancellation or rescheduling.
8. Service Performance and Limitations
8.1 Our operatives will exercise reasonable skill and care when carrying out the Services at your Premises. You acknowledge that waste collection and removal work can involve lifting, carrying and movement of items in confined or cluttered spaces.
8.2 You are responsible for protecting floors, walls, fixtures, fittings and surfaces that may be at risk during the removal process. We may, at our discretion, decline to move items through areas where damage is likely.
8.3 We do not dismantle or disconnect fixed installations such as gas appliances, hard-wired electrical devices, or built-in units, unless otherwise agreed with you and only where lawful and safe.
8.4 While we will use reasonable efforts to avoid damage, we will not be liable for wear and tear, pre-existing damage, or damage arising from weak or defective structures, fixtures or items.
9. Liability and Limitations of Liability
9.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under applicable law.
9.2 Subject to clause 9.1, our total liability to you for any loss or damage arising out of or in connection with the Services, whether in contract, tort including negligence, breach of statutory duty or otherwise, shall be limited to the total amount paid or payable by you for the specific job giving rise to the claim.
9.3 We are not liable for any indirect or consequential loss, including but not limited to loss of profit, loss of business, loss of opportunity or loss of goodwill, arising out of or in connection with the provision of the Services.
9.4 You shall be responsible for and shall indemnify us against any loss, damage, claim or cost arising from:
a. Your breach of these Terms and Conditions.
b. Your failure to disclose relevant information about the waste, the Premises, or hazards present.
c. Any claim by a third party regarding ownership of items removed.
10. Compliance with Waste Regulations
10.1 We operate in accordance with applicable UK environmental and waste management laws, regulations and codes of practice. This includes obligations relating to waste carrier licensing, duty of care, transport, recycling, reuse and lawful disposal.
10.2 Once collected and accepted by us, your waste becomes our responsibility, and we will manage it through authorised disposal or recycling channels as appropriate.
10.3 We may, at our discretion, provide you with a waste transfer note or other documentation where required by law or requested by commercial clients. You agree to retain any such documents for the period required under applicable regulations.
10.4 You must not request or encourage any unlawful dumping, fly-tipping or other illegal disposal of waste. We will refuse any request that would place us in breach of our regulatory obligations and may report suspected illegal activity to the relevant authorities.
11. Data Protection and Privacy
11.1 We collect and use your personal information in order to provide and administer our services, process payments, manage bookings and communicate with you.
11.2 We will handle your personal data in accordance with applicable UK data protection laws. Information will be stored securely and will not be sold to third parties. It may, however, be shared with payment processors, insurers, legal advisers, or regulatory bodies where necessary to fulfil our obligations or protect our legitimate interests.

12.3 If a dispute cannot be resolved directly between us within a reasonable period, either party may seek to resolve the matter through negotiation, mediation or by pursuing legal action in accordance with these Terms and Conditions and applicable law.
13. Amendments to These Terms
13.1 We may update or amend these Terms and Conditions from time to time to reflect changes in law, regulations, industry practice or our operational requirements.
13.2 Any updated terms will apply to new bookings made after the revised version has been published or communicated. For existing confirmed bookings, the version in force at the time of confirmation will apply, unless we mutually agree otherwise in writing.
14. Governing Law and Jurisdiction
14.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services including non-contractual disputes or claims, shall be governed by and construed in accordance with the laws of England and Wales.
14.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
15. General Provisions
15.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, illegal or unenforceable, that provision shall, to the extent required, be deemed deleted, and the validity and enforceability of the remaining provisions shall not be affected.
15.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.
15.3 You may not assign or transfer any of your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or subcontract our rights and obligations where this does not reduce the level of service or protection afforded to you.
15.4 These Terms and Conditions, together with any written quotation or service confirmation provided to you, constitute the entire agreement between you and us in relation to the supply of waste collection services in Elephant and Castle and supersede any prior understandings or agreements.
